State Dismissal - Payments

In terms of financial instability, some companies are forced to reduce the number of employees. Those who faced the reduction of states will come in handy information on the payment that rely in this case.

You must be warned about the dismissal of at least two months. When dismissal, the employer is obliged to list your day off, equal to average monthly earnings:

  • For calculation, salary is taken over the past 12 months. For example, if the date of dismissal is 01.12.2014, then the estimated period will be from 01.12.2013 to 01.12.2014. All changes in the salary and hospital are taken into account.
  • If you have been listed in the company for less than 12 months, then earnings are taken into account for the spent period.
  • At the rate excluded the simple fault of the employer, annual paid leave and business trips.

You will continue the right to earn money during the spirit of months after dismissal. For this, within two weeks from the date of dismissal, you must register on the Labor Exchange. Often employers offer an employee to issue dismissal at their own desire, arguing that there is no difference in the design. Do not agree to such persons, in this case you will not be able to qualify for the payments made you after the dismissal.

If after two months you will not find a job, then you have the right to receive another salary. To do this, you must provide a former employer with a certificate from the labor exchange and the workbook, in which there are no marks about the new employment.

You can come to a mutual agreement with the employer and quit immediately after notice, without waiting for the expiration of two months. In this case, you will pay earnings for the period from the date of dismissal to the date indicated in the notice.

In addition to additional payments, the employer is obliged to pay you salary and compensation for unused vacation. If you doubt the correctness of the calculation, ask you to provide you with a calculated sheet. The order of payments is regulated chapter 27 TK RF.

In violation by the employer of the current legislation, you retain the right to appeal to the employment inspection, the prosecutor's office or court. You can do this no later than three months from the moment of dismissal.
