  • received education should be first;
  • only full-time employees with full-time employees may apply for study leave or employees on a probationary period;

  • the employee must confirm the fact of training in a documentary formal (certificate, a call to the session, etc.);
  • vacation is paid only on correspondence formation.

The order of vacation decoration and its deadlines

According to st. 174 TC RF The timing of educational leave may vary - it depends on the degree of accreditation of educational institution and training courses:

  1. For higher education - time to prepare and passing the session is given in this order:
    • 40 days - on the first and second year of study;
    • 50 days - in the third, fourth and fifth courses;
    • One month - to pass state exams;
    • Four months - to pass the pre-diploma practice and the protection of the diploma.
  2. For professional (secondary or initial) education, recreation is provided as:
    • 30 days - for the first and second courses;
    • 40 days - the third, fourth and fifth year;
    • one month - on the state exams;
    • two months - to defend the thesis.

Calculation of holidays

According to TK RF Academic leave is paid in the same order as the next annual vacation - on the basis of the average daily salary of the employee over the past 12 months. Payment of holiday employee is relying until the session is careed.

However, when paying payments there are several nuances:

  1. If festive days fall during the passage of the session, they are paid along with the rest. Vacation time is not extended.
  2. During training holidays, hospital is not paid. Payments on the hospital leaf start from the first working day following after the rest.

  4. If the vacation begins with the middle of the month, payment is made on the basis of actually spent time.

Middle wages are determined in this way:

Let's analyze the calculation on the example:

At the moment, the employee receives parallel to the first higher education in the specialty, and it is already on the 4th year. On May 10, Petrov brings a challenge to the session and constitutes a vacation application from May 20, 2014 with a duration of 30 days.

Calculate the size of the holidays: (90,000 / 3 working months) / average number of days 29.4 \u003d 1020.40 rubles. Now the amount of 1020.40 rubles is multiplied by 30 days of vacation and we get legally assumed vacation taxes in the amount of 30612 rubles.
