Student contract - sample

The student contract is a legal document used in the Labor Code of the Russian Federation, requiring attentive compilation in its design, to avoid misunderstanding from both the employer (one can only be a legal entity) and by the employee.

When drawing up a head of an enterprise such a contract with a person in finding work, he agrees to his vocational training. By issuing a contract with an existing employee of this organization, management complements an existing employment contract and negotiates in the document that it is implied by a student treaty - retraining or vocational training, with liberation from labor activity or without separation from it.

The content and conditions of the document should not go against the TC RF and imply:

an indication of the names of the parties and their duties (providing the head of the necessary form of training: a term, brigade, individual, and a employee - passing it, in accordance with all stakeholders in the contract);
professional components (obtained: specialty according to profession and qualifications);
Working student, which should not exceed the time norms established by labor law;
labor payment, according to the current tariff, but not lower than the amount of the established minimum salary;
point on the possibility of mutual agreement to change the periods of learning stipulated in the contract;
the start time (the day of entry into force of the contract) and the completion of the student agreement, indicating not the time period, and the events marking the end of this term.

An employee who fulfills all the obligations established in the student contract, upon completion of the course of study, concludes an employer agreement with the head and continues to work without registration of the probationary period. If you violate your obligations stipulated in the contract, the trainee will have to reimburse the employer all expenses and funds spent during its training.
