How to sell the share of the land

How to sell the share of the land

To date, an increasing number of people are aware of the benefits of life on their land. Therefore, transactions of the sale and sale of land plots are becoming more popular every year. Not a rare case when the owner of the property in such a transaction is not one person, but several co-owners. In this case, the owner is interested in how to sell the share of the land.

1
The first and easiest option in terms of cost will be the sale of its share ownership. You do not have to carry out land management work, but for the commission of sale, you will need to resolve the remaining owners and their refusal of the preemptive purchase right.

2
In the second version it will be necessary to allocate its part of the land plot, completely by passing the right to use it on itself. For this:

  1. Check if the plot is registered and the right to it in Rosreestre.
  2. Order in the land management organization technical documentation ( cadastral engineer Must determine the boundaries of the land plot, geodesic coordinates, make a cadastral plan to establish frequent signs).
  3. Copies of land management documentation should remain in your hands.
  4. Contact the territorial body Rosreestra with a statement of registration. You will need the following documents:
    • copy of the passport;
    • documentation on land management in paper and electronic form;
    • certificate of payment of state duty;
    • a copy of the tax number assignment document;

If all the documents are drawn up correctly and your site does not violate the borders of others, after 14 days you will receive your cadastral number. Next, register ownership of your site and can be a sales contract.

An example of a completed sale and sale agreement of the land Swing here.

As can be seen from the two premises of the sale of the site, if the owner of the share has the ability to negotiate with other owners, it is more convenient to sell the undefided part. Subsequently, the buyer, becoming co-owner, can do the documentation. If the relationship with other owners do not get along, the only way out will be the allocation of its part and the extraction to the independent put on Earth.
