How to privatize an apartment

The privatization process is a shift of the owner: the state gives real estate in whole or in part in private hands. A citizen thus acquires the right to carry out various real estate operations, such as selling, donation.

The legislation of the Russian Federation identifies the conditions for the privatization of the apartment:

  • privatization is voluntary;
  • you can privatize the apartment in which it is registered;
  • public property privatization is made free once;
  • you can issue both overall privatization (on all family members) and privatization per family member;
  • privatization entities may be all citizens of the Russian Federation, including minors;
  • take advantage of the second time the right of free privatization, a citizen may, if the first privatization in his name was framed when he was a minor;
  • in accordance with the legislative base of the Russian Federation, in privatization it can be denied if the apartment is in disrepair;
  • not subject to privatization of the room in hostels.

Required documents:

  • originals and copies of identity documents;
  • apartment warrant;
  • social hiring agreement;
  • extract from the State Cadastra in the form of a cadastral passport;
  • explanation of the apartment;

  • certificate of changing the surname, about replacing the passport - if necessary;
  • extract from the registration authority that the right of free privatization has not yet been used.

The result of privatization is a written document - a transfer agreement that does not require notarization. On the one hand, the name of the state or municipal authority, the institutions, on the other, is the data of citizens who have the right to use a privatized apartment.

Sequence of actions when making an apartment privatization:

  • make a request to the Rosreestr for free extract from the State Cadastre, get a cadastral passport to the apartment;
  • request a request to the technical inventory bureau for free explication issuance;
  • subscribe to the local department of the Department of Housing Policy from all applicants for the privatization of family members who have reached 14 years of age;
  • provide a package of necessary documents;
  • the privatization solution is made within 60 days;
  • sign the real estate transfer agreement by obtaining ownership of the apartment;
  • register the right to ownership of the apartment in the Unified State Register.
